# How To Implement A Dust Control Management Plan For HSE Inspections

Following a complaint, a reported incident, or as part of a targeted HSE campaign, an HSE inspector may attend your site to examine whether your business is managing exposure to hazardous dust in accordance with the Control of Substances Hazardous to Health Regulations 2002 (COSHH). Visits can be announced or unannounced, often leaving sites little time to prepare. Unfortunately, HSE does not prescribe a standard COSHH form. It’s left to you to assess exposure risks, implement suitable measures and review them. If you employ five or more people, you must record any significant findings and make them accessible to inspectors and safety representatives.

Read on as we explore how to implement a practical dust control management plan for HSE inspections.

## **Build The Plan Around Work Activities And Exposure**

Many sites base their dust control management plan on the substance register, which is a reasonable place to start. However, while a substance register may list the materials brought onto site (e.g. iron ore, cement, or stone as bulk materials), it may not separately identify the airborne dust produced during the work itself. Tipping, screening and cleaning can create a hazardous airborne substance even when the original material has no safety data sheet. This is an important distinction because HSE’s COSHH assessment guidance treats a substance as hazardous only in the form in which it occurs during the work.

To avoid inadvertently missing hazards in your management plan, build the plan from activities up, rather than substances. Give each dusty activity its own entry. Record the task and location, material, emission source, people exposed, frequency and duration, conditions that increase release, existing controls and remaining risk. Include staff working nearby, maintenance teams and contractors where exposure is reasonably foreseeable.

Your assessment should also explain why each control fits the release mechanism on your site. Prevention or substitution has priority, followed by process design, enclosure and control at source. Where a dust cloud could burn or explode, cross-reference your assessment under the Dangerous Substances and Explosive Atmospheres Regulations 2002 (DSEAR). DSEAR addresses fire and explosion risk; COSHH addresses exposure-related health risk.

## **Give Every Control A Defined Performance Condition**

Your plan should also define acceptable operation – i.e what effective operation looks like for each control. This gives your operators a defined standard to check against and makes faults easier to flag. For each control, specify its required condition, checking method and frequency, responsible role, maintenance trigger, failure response and retained evidence.

Use the commissioned settings, operating instructions and process requirements as your reference. A failed check should trigger an interim precaution, repair, recheck and recorded closure.

An important note: Local Exhaust Ventilation (LEV) requires its own evidence. Your operators will need a simple way to recognise lost airflow, while maintenance and examination records demonstrate continuing condition. Under COSHH, most LEV plant must undergo thorough examination and testing at least every 14 months, with shorter maximum intervals for specified processes. [Regulation 9](https://www.legislation.gov.uk/uksi/2002/2677/regulation/9) requires records to remain available for at least five years.

Your commissioning data, shift or pre-use checks, maintenance and corrective actions should be traceable to the equipment or control zone concerned, creating a continuous performance record.

## **Use Findings And Failures To Trigger Review**

Exposure monitoring and health surveillance answer different questions. Monitoring measures airborne exposure to demonstrate adequate control. You may need it if your assessment cannot establish control reliably by other means; but it is not automatic for every dusty task. A visible plume can reveal a fault, while its absence cannot quantify individual exposure. HSE’s monitoring guidance explains this distinction.

Health surveillance looks for work-related changes in your employees’ health, and is required when an identifiable disease or adverse effect is linked to dust exposure, conditions on your site make its occurrence reasonably likely, and valid detection techniques are available. HSE’s health-surveillance criteria determine whether it belongs in your plan.

Set your review triggers around a new material, altered throughput, revised layout, control failure, maintenance trend, monitoring result, staff report or health-surveillance finding. Record the issue, immediate precautions, responsible role, corrective action, completion date and post-repair checks.

Good dust control management gives an HSE inspector a traceable chain from activity and exposure to control and verification, and following the inspection, your operations and maintenance teams can use the same record to detect deteriorating performance and close failures during normal production.
